How to Help Self-Employed Friends Find ACA Subsidies?

How much money should the government give you, to help you pay for health insurance? The Affordable Care Act says, roughly, that if you are in certain income ranges, then you should not pay more than a certain percentage of your income for benchmark insurance. The government money which pays for the rest is called your ACA subsidy or tax credit. So what's the problem? An Uber driver, a private tutor, and small business owner are all self-employed people---for these people, out-of-pocket cost for health insurance is subtracted from business money to find their income. But out-of-pocket cost is whatever the subsidy doesn't pay for! So subsidy depends on income, but income depends on subsidy. It's a math problem. How much money are they supposed to get? The IRS has methods from Publication 978 to try to find out. Unfortunately, these don't always find the largest subsidy for which an individual or family is eligible---worse, these flawed methods have been copied by tax software and government calculators. Many self-employed people are eligible for money who are being told that they or not, or for more money than existing calculators indicate. This is a ten minute video recorded by an NYU professor, where I use worksheets to introduce three students to this problem, and explain that I have solved it. I have a new method which will always produce the right subsidy amount for self-employed people. The full details will be explained in a future mathematics research paper, but a Google software engineer is helping me make an online subsidy calculator using my method, which will be available soon on my website, hosted by the Courant Institute at NYU. Until it is ready, my website will be down for maintenance as the algorithm is programmed. A surprising result in my research paper is that, while the subsidy as a function of income for employees has two "subsidy cliffs," the subsidy as a function of earned income for the self-employed is continuous. There are effectively no subsidy cliffs for the self-employed.

Federal tax reform legislation was signed into law on December 22, 2017 and contains a provision that eliminates the individual mandate penalty starting in year 2019. Some may have questions about how elimination of the individual mandate penalty may impact their health coverage. What does this mean? - The only coverage-related change made by the new tax law is that the individual mandate tax penalty will no longer be in effect beginning in 2019. - The health insurance coverage, including financial assistance (subsidies/tax premiums), will NOT change in 2018. - The individual mandate penalty remains in effect for 2018 coverage; which means you will need to be insurance if you want to avoid paying a penalty in 2018. Answers: It depends on the plan, but some plans have the following cost-sharing elements that you should be aware of. Co-Payments: Some plans include a co-payment, which is typically a specific flat fee you pay for each medical service, such as $30 for an office visit. After the co-payment is made, the insurance company typically pays the remainder of the covered medical charges. Deductibles: Some plans include a deductible, which typically refers to the amount of money you must pay each year before your health insurance plan starts to pay for covered medical expenses. Coinsurance: Some plans include coinsurance. Coinsurance is a cost sharing requirement that makes you responsible for paying a certain percentage of any costs. The insurance company pays the remaining percentage of the covered medical expenses after your insurance deductible is met. Out-of-pocket limit: Some plans include an out-of-pocket limit. Typically, the out-of-pocket limit is the maximum amount you will pay out of your own pocket for covered medical expenses in a given year. THE PARADIAGM SHIFT IS ALREADY HAPPENING In the 1970’s we made the transition from a defined benefit model called “Pension” to a defined contribution model called “401 K”. IBM, GE, Sears, AON, Papa Johns, TimeWarner and host of other major U.S. employers have already adopted some form of a defined contribution plan to provide health insurance for their employees. According to S&P Capital IQ, by the year 2020 90% of the people who are currently on an employer sponsored group health plan will be on some form of exchange based product. Even if they are wrong and it’s only 50%, shifting 50% of any industry in 6 years is a tidal wave. If the employee wants to add his/her family members to the plan, in most cases they can but the employee has to bear the additional cost in its entirety. In other words, the employer is subsidizing part or all of the employee’s health insurance premiums but none of the family’s. The Affordable Care Act on the other hand was specifically designed to subsidize the entire family unit. The reality is that most employers cannot possible afford to compete with the Federal government in subsidizing health insurance for the company’s employees. COMMUNITY PRICED HEALTH INSURANCE IS CHEAPER THAN PREMIUMS BASED ON YOUR GROUP’S HEALTH HISTORY As high as the Affordable Care Act premiums are, group health premiums are higher. Compare the total premium for an individual on any group health plan in the market today with the retail cost of a comparable Affordable Care Act plan purchased without a subsidy and the total premium for the group health plan for an employee will be higher. If you have a current group health plan, run the numbers yourself. Go to www.ehealthinsurance.com and see for yourself. This is because the pricing for Affordable Care Act compliant plans on the open market is based on “community pricing” rather than the health history of a particular group of individuals. It’s just a much larger group of folks, so the risk is less for the insurance companies. Again, like the law, love it, or hate it, it’s the law we have. IT’S IN YOUR EMPLOYEES’ BEST INTEREST Employees don’t care how the cost of their insurance goes down, they just care that it does. Unless you as an employer are ready to subsidize upwards of 80% of the cost of insuring your employee and their entire family, it’s simply cheaper for the employee to get a subsidy from the Federal government. We are at a turning point in American benefits history when offering health insurance to our employees may no longer be in their best interest and may no longer be a real benefit. In addition, under the defined contribution model, employees can chose any health insurance plan offered in the state from any carrier that meets their needs. There’s no more concern about changing health carriers and having employees complain that their doctor does not accept the new company health plan. HEALTH INSURANCE CAN STILL BE A BENEFIT YOU OFFER Through the use of flex plans as outlined in section 125 of the IRS code, employers can still provide substantial health benefits to their employees including offering them the opportunity to pay for their health insurance premiums in employer provided pretax dollars. Rand Paul (R-Ky.) is calling on Republican Senate leaders to introduce several important changes to their plan to replace Obamacare, including one very unique reform idea that has the potential to dramatically change the U.S. health care system. Paul is one of several conservative Republicans in the Senate who say they can’t vote in favor of the Senate leadership’s proposal to replace the Affordable Care Act — the Better Care Reconciliation Act — in its current form. According to Paul and other conservatives, including Sens. Ted Cruz (R-Texas) and Mike Lee (R-Utah), the BCRA keeps too many of the problematic provisions in the Obama-era ACA in place. On June 27, Paul sent a letter to Senate Majority Leader Mitch McConnell (R-Ky.) urging him to adopt several important reform ideas. Among them was the expansion of “Association Health Plans” in the BCRA. The expansion of AHPs would allow organizations and individuals to form associations for the purpose of buying group health insurance. Existing associations could also buy health insurance in this way, significantly increasing the power of consumers in negotiating rates and helping to resolve problems related to the ACA’s pre-existing conditions clause. In his letter to McConnel, Paul wrote that he wants “the language [in the BCRA to] be changed to allow any individual, including self-employed individuals, to form associations for the purpose of purchasing group health insurance.” If passed into law, Paul’s proposal would have far-reaching implications for the U.S. health care market. Under the current system, most Americans are insured through either a family member, an employer or the government. Those who work for small businesses that don’t offer insurance and individuals who are uninsured for some other reason have been required to buy insurance as individuals. This has given them significantly less negotiating power than the power enjoyed by large employers when negotiating rates, and prior to the passage of Obamacare, it put people who did not have employer-provided health insurance but were suffering with a pre-existing health condition at a significant disadvantage. Since Obamacare was implemented, individuals with pre-existing conditions have been able to purchase health insurance, but health insurance prices have skyrocketed as a result, exacerbated by the fact many health individuals have chosen to pay the Obamacare penalty for not having insurance rather than pay for increasingly expensive health insurance plans that have gigantic deductibles. Many free-market health care experts believe Paul’s plan for association health plans would go a long way toward resolving these problems, because individuals could purchase health insurance together. The larger the group, the more powerful it would become in negotiating prices, and the less the pre-existing conditions of some of its members would matter. This is precisely why, along with tax advantages, large-employer health insurance plans are so attractive to many employees. Imagine, for instance, the advantages of receiving your health insurance through your church, rather than an employer. Wealthier families in the church could help subsidize the cost of insurance for the lower-income families without the government getting involved, insurance rates would be cheaper than if an individual were to seek health insurance on his or her own, the church could ensure that the health insurance policies purchased are in line with the congregation’s religious beliefs and people who lose their jobs or switch their employers would no longer need to find a new insurance plan. The same could be true for almost any association of like-minded people, including groups like the National Rifle Association and retirement organizations. The GOP’s new tax bill, which passed Congress on Wednesday afternoon after one last vote in the House of Representatives and will be signed by President Donald Trump, is also a health care bill. The tax bill does at least as much (if not more) to upend Obamacare, or the Affordable Care Act, than even all of the Trump administration’s thousand cuts to the health law over the past year by repealing the individual mandate. Which raises the question: Just what is the Obamacare individual mandate? And what does its repeal mean for Americans? For starters: Contrary to a statement that President Trump made Wednesday, nixing Obamacare’s individual mandate does not mean that Obamacare has been repealed in the GOP tax bill. The individual mandate, which requires most Americans (other than those who qualify for a hardship exemption) to carry a minimum level of health coverage, is actually still in effect for 2018—meaning that you may have to pay a steep tax fine if you don’t have health insurance, for one thing. And even after the individual mandate repeal goes into effect the following year, Obamacare’s individual insurance markets, federal subsidies to help Americans pay monthly insurance premiums, and Medicaid expansion in the dozens of states that implemented it will all still be in effect barring further Congressional action. That’s because the vast majority of Americans receive health coverage through their employer or through a public health program like Medicare, Medicaid, or military health services. Obamacare’s private, individual insurance markets (which, again, will still be around after the mandate is gone, and more than 70% of consumers can purchase government-subsidized plans in them) will go through some turmoil, though. Those markets are meant for people who don’t have access to employer coverage but make too much money to qualify for safety net programs like Medicaid, or Americans who are self-employed. The entire point of Obamacare’s individual mandate is to make sure that it’s not just sick people who are buying health insurance in these markets. By widening insurance risk pools to include a mix of young and old, healthy and sick, premiums go down in the overall market (and people don’t simply sign up for insurance when they’re sick only to ditch it when they don’t need coverage anymore).

Rand Paul Offers Interesting Plan to Dramatically Transform U.S. Health Care System Sen. Rand Paul (R-Ky.) is calling on Republican Senate leaders to introduce several important changes to their plan to replace Obamacare, including one very unique reform idea that has the potential to dramatically change the U.S. health care system. Paul is one of several conservative Republicans in the Senate who say they can’t vote in favor of the Senate leadership’s proposal to replace the Affordable Care Act — the Better Care Reconciliation Act — in its current form. According to Paul and other conservatives, including Sens. Ted Cruz (R-Texas) and Mike Lee (R-Utah), the BCRA keeps too many of the problematic provisions in the Obama-era ACA in place. On June 27, Paul sent a letter to Senate Majority Leader Mitch McConnell (R-Ky.) urging him to adopt several important reform ideas. Among them was the expansion of “Association Health Plans” in the BCRA. The expansion of AHPs would allow organizations and individuals to form associations for the purpose of buying group health insurance. Existing associations could also buy health insurance in this way, significantly increasing the power of consumers in negotiating rates and helping to resolve problems related to the ACA’s pre-existing conditions clause. In his letter to McConnel, Paul wrote that he wants “the language [in the BCRA to] be changed to allow any individual, including self-employed individuals, to form associations for the purpose of purchasing group health insurance.” If passed into law, Paul’s proposal would have far-reaching implications for the U.S. health care market. Under the current system, most Americans are insured through either a family member, an employer or the government. Those who work for small businesses that don’t offer insurance and individuals who are uninsured for some other reason have been required to buy insurance as individuals. This has given them significantly less negotiating power than the power enjoyed by large employers when negotiating rates, and prior to the passage of Obamacare, it put people who did not have employer-provided health insurance but were suffering with a pre-existing health condition at a significant disadvantage. Since Obamacare was implemented, individuals with pre-existing conditions have been able to purchase health insurance, but health insurance prices have skyrocketed as a result, exacerbated by the fact many health individuals have chosen to pay the Obamacare penalty for not having insurance rather than pay for increasingly expensive health insurance plans that have gigantic deductibles. Many free-market health care experts believe Paul’s plan for association health plans would go a long way toward resolving these problems, because individuals could purchase health insurance together. The larger the group, the more powerful it would become in negotiating prices, and the less the pre-existing conditions of some of its members would matter. This is precisely why, along with tax advantages, large-employer health insurance plans are so attractive to many employees. Imagine, for instance, the advantages of receiving your health insurance through your church, rather than an employer. Wealthier families in the church could help subsidize the cost of insurance for the lower-income families without the government getting involved, insurance rates would be cheaper than if an individual were to seek health insurance on his or her own, the church could ensure that the health insurance policies purchased are in line with the congregation’s religious beliefs and people who lose their jobs or switch their employers would no longer need to find a new insurance plan. The same could be true for almost any association of like-minded people, including groups like the National Rifle Association and retirement organizations. It remains unclear whether McConnell and the rest of the Senate leadership is willing to add Paul’s proposal to expand association health plans to the Better Care Reconciliation Act.

Purchasing a high deductible health plan in the individual market, through the Affordable Care Act (Obamacare) or even choosing a policy through work, can be very complicated and confusing. Many people have a hard time sorting through all of the different options that are available to them. Deciding which policy is best for your individual situation can give you quite a headache. One decision that you will have to make is about your deductible. In an insurance policy, a deductible is the amount that you are responsible for paying before your coverage kicks in. For example, if a health insurance policy has a $5000 deductible, you won't get any coverage from it until you have paid $5000 out of your own pocket. These high deductible health plans may not seem like a great bargain since you have to pay so much before you get any benefits. However, along with a high deductible comes lower premiums. Since insurers do not have to pay as much for these policies, they do not charge premiums that are as high. In many cases, you can see significant savings on your premiums if you choose an insurance plan that has a higher deductible. The bigger the deductible, the lower your premiums. Some high deductible health plans come with premiums that are 50 percent lower than comparable plans that have lower deductibles. Figuring out the proper balance between your deductible and your premiums can be tricky. If you need further guidance, talk to an insurance agent or a health care expert. It features Don Shircel, Director of Client Development, and Anita Taylor, ASAP Program Director, from the Tanana Chiefs Conference (TCC). The TCC Tribal Temporary Assistance for Needy Families (TANF) program is called the Athabascan Self-Sufficiency Assistance Partnership (ASAP), which provides services to the Tribal members of 37 federally recognized Tribes in Alaska. These Tribal members face several challenges living primarily in very isolated rural communities with limited roads, infrastructure, and jobs. ASAP has six major activities (training, motivating, mentoring, mirroring, monitoring, and measuring) and offers Gila (Let's Go), a kickoff event to motivate Tribal members and provide them with workshops on customer service training, interview skills, resume building, and other information to help them obtain employment. The subsidized employment program, initially started with American Recovery and Reinvestment Act (ARRA) funding, brought more than 160 people on the welfare rolls from the villages to town and gave them the opportunity for full-time jobs, turning their welfare checks into paychecks. The subsequent collection of information that evidenced success convinced the State of Alaska to expand its use of State funds and invest them to continue the program.
