Will We Lose Our Family Home To Medicaid? As an Elder Law attorney one of my primary functions is to help families plan for how they are going to pay for long-term care. Establishing a long-term care plan for seniors is a multifaceted discussion and many times Medicaid is part of that analysis. One of the most common questions I receive when discussing Medicaid is "Will we lose our family home if my spouse (or my parent) receives Medicaid long-term care assistance". I can tell you that there is a great deal of misunderstanding by the public about which assets are protected and how much of the unprotected assets must be spent. Any discussion that deals with Medicaid and the assets an applicant owns will generally evolve around three separate components: (1) can the applicant "qualify" for Medicaid assistance; (2) is there an ability to "transfer" the home; and (3) will Medicaid be able to "recover" against the home for the cost of care provided. Medicaid Qualification There are specific financial criteria that must be met in order to qualify for Medicaid long term care assistance and every asset owned by the applicant and/or their spouse must be disclosed in the application process, even if it is owned jointly with someone else. The applicant's assets are categorized as "countable assets" or "excluded assets" and there is a limit on the amount of countable assets an applicant may have in order to qualify for Medicaid long-term care assistance. Generally, you do not have to sell your home in order to qualify for Medicaid long-term care assistance because the applicant's home can be excluded as a countable resource with certain limitations. First, to qualify for the exemption, the home must have been the applicant's primary residence. Also, for a single (non-married) applicant, the home will be excluded from the countable resources if the equity in the home does not exceed $536,000 and the applicant can demonstrate the intent to return to the home if health conditions improve and care is no longer needed. Note that it is the amount of the equity interest, not the value of the home itself. If the equity interest in the home is above the limit, the applicant will need to reduce the equity interest for the home to be excluded. If the applicant is married and the spouse occupies the home, then the home will continue to be exempt while it is actually occupied by the spouse without a limitation on the equity. Transfer of Home Transferring your home to your children (or someone else) may lead to a Medicaid penalty period, which would make you ineligible for Medicaid assistance for a period of time. However, there are circumstances in which you can transfer your home and not incur a penalty period. As an example, you can freely transfer your home to: • your spouse; • a child who is under age 20 or who is blind or disabled • into a Trust for the sole benefit of a disabled individual under age 65 • a sibling who has lived in the home during the year preceding the applicant's institutionalization and who already holds an equity interest in the home • a child of the applicant who lived in the house for at least two years prior to the applicant's institutionalization and who during that period provided care that allowed the applicant to avoid a nursing home stay However, each situation creates its own unique set of circumstances. It is important to consult an Elder Law Attorney before making any gifts or transfers. Estate Recovery Typically, dealing with the home is not an issue associated with qualifying for Medicaid. However, the home can become an issue following the death of the individual because federal law requires all states to establish an estate recovery program to seek recovery from the estate of a deceased individual for the Medicaid benefits they received. So how does estate recovery work? The Medicaid recipient becomes indebted to the state for the cost of care provided. Upon the Medicaid recipient's death, the personal representative of the recipient's estate is required to give the Nebraska Department of Health and Human Services written notice of the recipient's death and give them an opportunity to file a claim in the estate to recover the debt. Planning for estate recovery becomes more complicated for married couples where only one spouse is institutionalized because one must consider the possibility that either spouse (the institutionalized/nursing home spouse or the Community Spouse) may survive the other spouse. The main focus of such planning is centered on the assets in which the nursing home spouse had a legal interest at the time of death. As we age, the need to plan for long-term care will become a reality and Medicaid assistance may be necessary at some point. I encourage you to consult with a qualified Elder Law Attorney to determine whether there is an opportunity to protect your home from estate recovery.

The New York State Marketplace is a mess. I have various different jobs that have fluctuating pay rates. I am not a salaried worker. I am like millions of New York State workers who have multiple jobs to make ends meet. I work for various catering agencies and tv and film background agencies. I am considered an "on-call" worker and my relationships with some employers are immediately terminated after a job is done (which is typically a one day shoot). I am often paid though, by a handful of payroll companies so my employment appears to be consistent. My employment varies. My employment also has a season aspect to it. Both catering and television have peak periods of employment and then times when employment is dead. My problem has been, since my employment fluctuates, certainty cannot always be determined by NY State of Health. I have been evaluated as being eligible for Medicaid, then suddenly I'm dropped and have to be re-evaluated. Then I'm told I only qualify for the higher earning bracket, paying $250.00 a month. Then when I support documentation that this would be a burden, I qualify for the Essential Plan. In October, I was on the Essential Plan, but being told I had to send income verification as my plan was terminating. I sent information. Then I got another notice that I was still being terminated. Then I sent more payroll information. Then I was told I would actually qualify for Medicaid. I actually preferred to stay on my Essential Plan of $44 a month because I didn't want to change doctors or cancel visits. I feel as if I keep getting thrown off of my plans because whatever automated system is being used to profile members is flawed, especially when it comes to workers with fluctuating pay. I am the kind of worker most people SHOULD be proud of - I hustle! I hustle every day for my employment. But this is how my employment works. I would have more protections in an Actor's Union, which I am not in yet - but trying to get there. I would have more protections if the food and beverage industry was better regulated. There are MILLIONS of New Yorkers who work under "on-call" work status. We can be fired without just cause. Employers do not have to guarantee hours. I am not saying these employers must change their employment ways. What I am saying is the New York State Healthcare Marketplace is STILL not properly equipped with dealing in the various work statuses that exist. The state needs to address how they deal with working class people who fall into the job categories that I do. There are MILLIONS of food service workers, custodial workers, construction workers, temps, and even health care workers who all fall under similar working conditions as myself. I am told there is only "one" evaluation a year to determine one's healthcare eligibility. Then, why have I be re-determined and terminated by my healthcare serval times this year? Isn't there a responsibility to ESCALATE people in my employment conditions? We are MANDATED to have healthcare! And if you do not know how to address people like me, in an expedited matter, there is a problem with the system. What is truly frustrating is when the NY State Marketplace agents keep telling you what YOU'RE doing wrong, when they are the ones in control of the confusion. And holding individual agents accountable is nearly impossible. It's also impossible when the supervisors also don't know how to correct what has been done. Can I get my Attorney General on this?

What Happens If Estate Planning (Will or Trust) Attorney Retires or Dies?

What happens to your Will or estate plan if your estate planning attorney dies, retires, quits practicing, or is otherwise not available when you or your family need estate legal services in the future? I get this question often. Clients mistakenly believe that their estate legal program will fall apart if the attorney who prepared and implemented the plan is not around at a later date. People who put an estate legal program in place typically have either a Will-based plan or a Living Trust-based plan. Over the years, many people have gone to "other" attorneys or firms to get their Will done. Later, when they need to change their Will (perhaps change the heirs; or change the executor) they come to me to either make the changes, or, when someone dies, to handle the probate (also known in Louisiana as "Succession"). When we provide those subsequent legal services, the previous attorney or firm does not have to be located or communicated with. Easy to make the transition. When someone creates a Living Trust-based estate planning program, they often mistakenly believe that legal documents must be updated every time they buy or sell property, or even open an investment account. That assumption is incorrect. The key is, simply, to buy the new property, or open the investment account, in the name of the trust. And when the Settlor of a trust dies, note that many Living Trusts are settled with no attorney involvement whatsoever. So if the attorney who helped you implement your Trust-based plan is not around when you need to name new beneficiaries, or settle the trust when you die, it's OK. It is not unlike when you lose the services of your doctor, your CPA, or your financial advisor. You simply find someone else that you know, like, and trust to pick up where you left off with the other professional service provider. But note that on a personal note, it looks like my three oldest children will be lawyers. My oldest passed the Bar Exam and became a lawyer four months ago. My second son is in his second year at LSU Law School - his plans have always been to come work with his old man. My third son graduated in Finance a semester early and has been admitted to both LSU and Tulane law schools. So, it's likely that my firm will be around for, let's say, at least another 50 years or so - but who can predict the future? With terminology out of the way, next in the Medicare Explained video is Medicare Part A & Medicare Part B. Medicare Part A is that portion of your health insurance that pays for your healthcare whenever you are an inpatient in a medical facility. As soon as you become an inpatient in a hospital, Medicare Part A takes over. The same when you become an inpatient in a skilled nursing facility or hospice. The one exception is that if you are not able to physically get to a medical facility for healthcare, Medicare Part A also pays for home healthcare. Think of Medicare Part A is inpatient insurance. Medicare Part B is the part of Medicare that pays for outpatient and physician services. This is the portion Medicare insurance you use when you see a doctor or have lab tests or physical therapy and so on. Medicare Part B also includes some wellness coverage. Medicare Part B is the part of Medicare people use most often because most of our medical care is via outpatient services. Even many surgeries and hospital services are now done as an outpatient and are thus covered under Medicare Part B. Your Original Medicare (Part A & B) is good anywhere in the country. You can see any doctor, go to any medical facility in any state or territory, as long as they accept Medicare. You do not need to get permission from a primary care physician. You have both freedom to go where you need and control to see who you choose. Also it is important to understand that Medicare Advantage Plans are local coverage. If you are a snowbird, and RVer or just travel the country that should rule MAPD as an option. Next in our Medicare Explained video are your three choices. You can do one of three things: # 1 Do nothing. Just keep Original Medicare (Your Part A & B). This is the only choice that makes understanding those co-pays and deductibles very important. This is not an advisable choice because Original Medicare was never intended to be stand-alone health insurance. You will find when going over the details of the copays and the limits of the coverage that there is no maximum out-of-pocket limit on your potential financial obligation. You are at substantial financial risk. Still, this is a choice some people make. # 2 You can trade in your Medicare Part A and Medicare Part B for a Medicare Advantage Plan. Medicare Advantage plans are also called Medicare Part C. #3 Your third choice is to keep you Original Medicare Parts A & B, but add a Medicare supplement plan that pays the co-pays and deductibles that come with just Original Medicare, so you don’t have to. If eligible you can sign up for Part A free at any time. The enrollment period is from January 1 through March 31. July 1 is when your coverage begins. This could change if you also carry insurance through your employer. Ways to Sign Up for Coverage You can visit your local Social Security office or visit their website (Socialsecurity.gov/Medicareonly). You can call Social Security Administration and complete the process over the phone. You can also get information on enrollment through Medicare.gov. You can obtain an application through CMS (Centers for Medicare & Medicaid Services) online to download instantly. When you sign up you do so only once. Each year your coverage remains active as long as required premiums are paid. Beneficiaries are encouraged to review plan details each year as some may vary. During open enrollment period you can make changes to your coverage if necessary. What Else Should You Know? When signing up for Medicare Part A and Medicare Part B you don’t have to obtain both parts. If you drop your coverage you can reenroll during the enrollment period to avoid penalty. You can sign up for Part A without Part B, but if your sign up for Part B you may be required to get Part A. How is an independent insurance agent or broker different from a regular insurance agent and why is this important to you as you shop for a Medicare plan? Right at the top of the front page of our website, in clear view for all to see are the words “An Independent Insurance Broker.” As a result, almost every week people ask us, what is an Independent insurance broker and how is that different from insurance agents. Well, the difference is substantial. It’s the difference between a person who represents your best interest and a person whose job is to sell you something regardless of what is in your best interest. In the insurance world there are two types of agents; the independent agent or broker and the captured agent. The captured agent is an employee of an insurance company. They may work for Mutual of Omaha, Colonial Penn, or UHC /AARP, Blue Cross Blue Shield or any insurance company. Because they are employees of that insurance company they are only allowed to show you and discuss plans from their employer. In insurance, the agent is required to be licensed in each state they work in AND with each company they wish to do business. Because a captured agent is an employee of an insurance company, that company will not allow them to offer products from other companies. They are captured by their employer. They are only paid if they can get you to buy one of their employers’ products. An independent insurance broker is a completely different experience. An Independent Insurance Broker does not work for an insurance company. They often run their own insurance agency and are contracted with all the major insurance companies or at least those with the most competitively priced products in your area. Because they can work any of the companies available, the independent insurance broker can show you all the plans that are available to you, the prices from multiple companies and the price history from each of these companies. They work in your best interest, finding the right plan and best price of all that is available to you. It doesn’t matter which plan you choose, or company because the independent insurance broker can help you with any option you choose and get paid to do so. By the way, you don’t pay the independent insurance broker. The broker is paid by whichever company you choose to get your Medicare supplement through as long as the broker helps you with the application process. It cost you nothing to work with an independent broker. You pay the same price whether you go directly to an insurance company, use one of their captured agents or have an independent broker help you. Even after you already have a Medicare supplement, you get more value and service with an independent broker. If your plan ever has a large increase in price, the independent broker can re-shop the entire market to find a better priced plan. All the captured agent can do is hope you don’t re-shop your plan. If this applies to you, then you might be wondering how Medicare Supplemental coverage works while traveling. According to CMS as of January 2017 more than 515,000 Medicare providers actively receiving payments) and that large network is a real benefit to you while traveling. I’ll share with you all the details on how Medicare Supplemental coverage works while traveling in the United States, abroad, and how Medicare Supplement plan coverage differs from Medicare Advantage plans. And, make sure you read to the end of this post where I share tips on how to use your Part D drug plan while traveling. The great news about Medicare Supplement insurance is that it can travel with you across all 50 states and U.S. territories. So, all you have to remember is that a provider who accepts Medicare also accepts your Medicare Supplement plan...regardless of who your Medicare Supplement insurance company is. It’s not about the name of the Medicare Supplement insurance carrier, it’s about seeing providers in Medicare’s network. As long as the provider or facility accepts Medicare, your Medicare Supplement insurance company will pay the required costs associated with the Outline of Benefits for your Medigap plan. But can you use Medicare out of the country? Medicare is very limited in what it covers for foreign travel. And, in most cases, Medicare won’t pay for health care or supplies you get outside the United States and U.S. territories. However, there are 3 situations in which Medicare will cover health care services in a hospital setting located in Canada or Mexico. See the link at the top of this post that takes you to CMS’s four page publication that goes over those rules in detail. Medigap plans C, D, E, F, G, H, I, J, M, and N pay 80% of the billed charges for certain medically necessary emergency care needs outside the U.S. after you meet a $250 deductible for the year. Keep in mind, these Medigap policies cover foreign travel emergency care if it begins during the first 60 days of your trip, and has a lifetime limit of $50k. Medicare Supplement Plans and Medigap plans are the same type of health coverage. But, Medicare supplement plans are not the same as Medicare advantage plans. They don't work the same while traveling. One reason is because MAPDs don’t use Medicare's vast network. Medicare Advantage Plans are HMOs and PPOs and have service area networks. Variables such as how long you travel, where you travel, and the kind of care you need will impact whether or not your care will be covered while traveling or living somewhere part time. And, as for foreign travel, some Medicare Advantage Plans cover emergency care outside the U.S. but, again, you have to check the plan benefits to see what costs and rules apply. Which is completely different than Medicare Supplement plans, where you don’t have to constantly check plan benefits or your provider network. As long as the provider accepts Medicare (in the U.S. and territories), you’re covered… and your Medigap plan F, Medigap Plan G, or Medigap Plan N will pay accordingly. This offers greater peace of mind and ease of use while traveling compared to MAPD. And, let me share with you an example of how Medicare's network really came in handy for your father in law. He was visiting us before traveling out of the country and the day he was leaving for his trip, he noticed a spot on his skin that was bothering him. He wanted to have it checked before his trip. However, he was at our house and nowhere near his dermatologist. But, since he had Medicare and A Medigap plan, he was able to visit a dermatologist near my house with no network issues. Now, if he had a Medicare Advantage Plan, he would have been out of the plan's service area, and wouldn't have in network coverage. And...since it wasn't an emergency, it definitely wouldn't have been covered once he left the country. Lastly, if you have a Part D plan or are planning to get one, make sure you choose a plan that has national coverage so you can get prescriptions filled while traveling. If you use Medicare’s Plan Finder Tool, keep an eye out for the little N that indicates National Coverage. And, if you choose a plan that only provides coverage at one retail location (like the AARP Walgreens plan), then keep that in mind if you know you’ll be traveling.

Medicaid Redesign Team, an Innovations in American Government Awards finalist, presented before the National Selection Committee in 2015. The Medicaid Redesign Team (MRT) of New York State was launched by Governor Andrew Cuomo with the explicit mission of overhauling the nation’s largest Medicaid program. Upon taking office, Governor Cuomo determined New York’s Medicaid program was spending more than $50 billion annually and was growing at an unsustainable rate, putting the state’s entire budget in serious jeopardy, with unacceptable health outcomes for Medicaid members. Recognizing the program required real reform pursued in collaboration with key stakeholders, Governor Cuomo issued an executive order in January 2011 that called for the creation of the MRT to uncover ways to save money and improve quality within the Medicaid program for the 2011–12 state budget. MRT members included health care industry leaders, business and consumer leaders, state officers, and state legislative members. The MRT utilized an intensive stakeholder engagement process to develop a plan to reduce costs in New York’s Medicaid program while also focusing on improving quality and implementing reforms. MRT reforms saved taxpayers $2.2 billion dollars in the first year, and will save $34 billion in state and federal dollars in the first five years of implementation. The MRT plan includes: - Care Management for All: a multiyear phase-in to care management for all Medicaid members, resulting in healthier patients and lower costs. - Patient Centered Medical Homes (PCMHs): increased financial incentives for providers to become nationally certified PCMHs. More than 1.6 million Medicaid members are now enrolled in PCMHs, where they have ongoing relationships with a personal physician and care team that takes collective responsibility for patient care. The goal is that within five years, all Medicaid members will be enrolled. - Healthy Homes: a “high touch” care management model that serves high-need/high-cost Medicaid populations with expanded care coordination capabilities. - Global Medicaid Spending Cap: established a two-year state-share dollar cap and a four-year state-share spending cap, monitoring Medicaid expenditures more closely than ever before. A global spending report is published to the MRT website monthly so the public can track performance. MRT changed the political environment by bringing key stakeholders together to develop a multiyear reform plan. Most observers predicted failure. However, thanks to strong leadership and commitment, the process worked and the stakeholders were able to come up with a plan to transform the program. Over 230 separate initiatives have been or are still being implemented, and savings have been significant. Since the inception of MRT in 2011, per recipient spending has been reduced by approximately 10 percent, bringing spending in line with 2003 levels. Overall spending has been held virtually flat during a period of enrollment growth driven by a weak labor market and the Affordable Care Act. The reform process and the plan itself are being looked at by states across the nation and could be a model for national entitlement reform. MRT also created the opportunity for federal approval of a groundbreaking Medicaid waiver that is now being implemented to transform health care delivery, which will benefit all 19.5 million New Yorkers.

It packs a lot of coverage into a very well-priced, low-cost package. On average, a Medigap Plan N will cost between 25% and 35% less than a Plan F, saving $600 or more in annual premiums. How is a Plan N different that the complete coverage of a Plan F? Medigap Plan N is different than a Medigap Plan F is three ways. First, you pay the annual Medicare Part B deductible. That deductible is just $166 per year as of 2016. It may be more or less in the years ahead. Only Medigap Plan F and Medigap Plan C pay that Medicare Part B deductible, and that is why those two plans will be discontinued as of 2020. Medigap Plan N and all other Medicare Supplements require you to pay the annual Medicare Part B deductible. It’s just $166 and it’s no big deal compared to the hundreds of dollars you save in premiums. The second way Medicare Supplement Plan N is different that a Medicare Supplement Plan F is that with Plan N you pay up to a $20 co-pay when you visit the doctor and a $50 co-pay for an emergency room visit unless you are admitted to the hospital. If you see a doctor a couple times per year, a $20 co-pay is a fair exchange for the hundreds of dollars in lower premium. The third and final way that a Medicare Supplement Plan N is different that a Medigap Plan F is that Medigap Plan N does not insure against Medicare Part B excess charges. Now, this scares a lot of people until they understand how inconsequential this feature really is. Only doctors who do not accept Medicare Assignment can charge a Medicare Part B excess charge. Medicare assignment simply means that Medicare assigns the price to the service. Only 3%, three out of 100 doctors do not accept Medicare Assignment which then allows them to bill an excess charge. All you have to do is ask your doctor if they accept Medicare Assignment. Odds are 97% that they do. If so, then that feature of a Plan N is of no concern. If your doctor is one of the three out of one-hundred that does not accept Medicare Assignment, simply request that they bill you only the assignment rates so that Medicare covers the cost of his or her services. It’s that simple. Most seniors on Medicare never encounter a doctor that does not accept Medicare Assignment in their entire life. There you have it. If you are considering a Medicare Supplement to add coverage to your Original Medicare, consider and price at least Medigap Plan F, Medigap Plan N and Medigap Plan F-HD. In states outside of Florida, also, consider Medigap Plan G (detailed in a separate article). To find the best prices for each of these plans, simply complete a quote request. The benefits under early policies were often too generous relative to factors such as actual benefit utilization rates and lapses, according to Moody's. To compensate insurers had to increase reserves and raise rates to improve the profitability of older products. New, better designed and priced products seek to reduce risks for insurers, with changes including more restricted benefits and payout periods, as well as "combination" policies, which offer long-term care combined with a life insurance policy or an annuity contract. Nevertheless, Moody's believes potential buyers may balk at fewer benefits and higher rates, and sales could go down noting that senior citizens on fixed incomes form a highly sensitive constituency and regulators could therefore reject or limit new rate requests. The exit or retreat of five key firms from the market since 2010 leaves only one dominant player. MetLife and CUNA Mutual stopped selling LTC in 2010. In 2011, CNA and Berkshire pulled out. This year Prudential stopped selling individual to focus on group sales, while Unum stopped selling group but had previously pulled out of individual sales. Since the CLASS Act died, there are still few solutions to funding long-term care. Remember Medicare only pays for this in certain situations. Your choices are limited. Buy an expensive long-term care policy. Investigate the assurance benefit, in short, using your life insurance to pay for long-term care needs. Do effective, ethical and legal estate planning. Pay for long-term care out of pocket until you exhaust resources and then hope to qualify for Medicaid. None of these are sure bets. With block grants in states, there is no assurance that Medicaid will be able to continue funding long-term care. And who knows what will happen with Medicare. And remember, Medicare, Medicaid might be used for skilled nursing. Assisted living by and large is self-pay until you can't. Medicaid factors in at times but not usually. If you are smart plan to age in place. Which means plan to start looking at your house and what you need to do to it now to make it safe for living as you age. With more services moving to community settings, you will be able to access the care and transportation you need as well as find the social interaction that is vital to a quality of life at any age. And with tele-health options increasing, your health care will be increasingly monitored from home. People are fixated and rightly so on assuring everyone has health insurance for medical needs.
