In 1985, I first became interested in developmental life experiences in early childhood really by accident. In the major obesity program we were running, a young woman came into the program. She was twenty-eight years old, and weighed 408 pounds, and asked us if we could help her with her problem. And in fifty-one weeks, we took her from 408 to 132. And we thought, well my god, we’ve got this problem licked. This is going to be a world-famous department here! She maintained her weight at 132 for several weeks, and then in one three-week period regained 37 pounds in three weeks, which I had not previously conceived as being physiologically possible. That was triggered by being sexually propositioned at work by a much older man, as she described him. And in short order, she was back over 400 pounds faster than she had lost the weight. I remember asking her why the extreme response. After initially claiming not to have any understanding of why the extreme response, ultimately she told me of a lengthy incest history with her grandfather, from age 10 to age 21. Ultimately it turned out that fifty-five percent of the people in our obesity program acknowledged a history of childhood sexual abuse. I mean, that obviously is not the only issue going on, but it was where we began. And as we went down that trail, then we discovered other forms of abuse, also growing up in massively dysfunctional households, et cetera. Physical abuse is defined as the use of physical force that may result in bodily injury, physical pain, or impairment. I want to note that anyone can be physically abused. It doesn't matter if we are big and strong or small and weak. Anyone can be a victim. If you are in a physically abusive relationship, please reach out for help! There are professionals there to support you and places you can live so that you are kept safe. If you are working to recover from a physically abusive relationship, there are many treatment options! The first is for parents and is usually something legally mandated and that is family therapy and parenting classes. This can help the family better communicate with one another as well as help the abuser better manager their stress and anger. The second option is CBT. They say CBT works because it helps slow down the processing of distorted thoughts and beliefs so that the abuser can see what they thought was asserting themselves was actually abusive. If it's the victim in therapy, they can relearn how relationships are supposed to feel and see that their beliefs about themselves deserving the abuse etc are not true at all. Lastly, there is talk therapy! It can help to feel like someone is on your side, and you have a safe place to vent about everything that is going on. If you are in an abusive relationship or trying to process through a past one, please reach out for help! Sexual abuse, molestation and sexual trauma produces a potentially large number of symptoms in its victims. The following symptoms are found in patients who have come to seek treatment from professionals in hospitals, clinics, private practices or other treatment programs. Depression is the most common symptom of sexual abuse, molestation and sexual trauma, claiming 97% of all sexual abuse survivors. 60% will experience sexual dysfunction, 49% anxiety and panic, 48% suicide or suicide attempts, 48% substance abuse, 46% psychoses, 32% dissociative disorders (including multiple personality disorder), 29% borderline personality disorder, 24% self-mutilation (including cutting), 24% sexual identity disorder, and 12% antisocial personality disorder. Most victims of sexual abuse, molestation and sexual trauma will experience more than one symptom, sometimes several. However, all of these symptoms can be dealt with in a proper therapeutic setting. Victims need to realize that they are not alone, there is hope, they can get better. I've also included a real case where I represented a father with 2 children where the mother was addicted to methamphetamines. If you are seeking sole custody of your child one way to do this is to prove that the other parent is unfit. Proving unfitness of a parent is not always easy to do. In my practice I have been able to prove unfitness of a parent by proving evidence of drug abuse, alcohol abuse, alcoholism, etc. This includes both illegal drugs and prescription drugs. If the other parent has a history of drug abuse for a significant number of years this should be brought before the court. Also important is whether or not they are currently in a drug or alcohol treatment program. Have they been through treatment or rehab but continue to relapse? However they don’t have to have a drug or alcohol problem for a number of years. If you can prove that their is drug or alcohol abuse going on presently this is also taken into consideration. There are a things you can do to help prove drug abuse in a custody case: 1. Request ongoing court ordered drug tests in your custody case. A failed drug test in a custody case can be a good indication of drug addiction in the parent. 2. Be required to get a drug screening and be evaluated for a drug treatment program at treatment center. This involves being interviewed and assessed on how significant the substance abuse is. The center can then recommend a treatment protocol to follow. If the other parent fails to follow the treatment program this is very good for your case. Another Way to Show that a parent is unfit is to show evidence of child abuse or child neglect. Allegations of child abuse are very serious, so you must be prepared to back it up with proof. Abuse includes physical abuse, emotional abuse Some examples of child neglect can be not providing meals when they should, skipping meals,, not monitoring the child doing homework, missing school, being left alone at house, if they go to school tired or dirty, or without lunches, etc. If you can show a pattern of neglect it can show the parent is neglectful and should not have custody or parenting time. Also, if there is evidence of child abuse such as police reports, criminal conviction, restraining or protection orders they are good pieces of evidence to provide the judge in your custody battle. Now keep in mind that Just because the other parent has a substance abuse problem it does not necessarily mean they are unfit. The judge will look at many factors which are called the ‘Best Interest of the Child’ factors which by law the court has to consider all as a whole when making a decision in a custody case. So I would not hang my hat on just this one factor. It might be that the judge not give you sole custody but reduce the parenting time of the other parent. These are just a few examples to show unfitness of a parent in custody case. Substance Abuse and Neglect, Abuse are some very common issues that come through my office and which I have been successful in proving and securing sole custody of a child. Witnessing the degradation and deterioration of a drug abuser whose addiction has taken its toll offers a first-hand perspective on just how powerless certain people are against the potent sway of heavy drugs, not to mention the toll that they take on the body. In 2014, drug treatment assistance website Rehabs.com put together a graphic, stunning compilation of photos that captured the physical regression of chronic drug abusers through their head shots. This rather pointed effort, which gathered the mug shots of those arrested multiple times for drug- and/or drug-related offenses, served to highlight the potentially catastrophic health effects of drug abuse in a raw, visceral and impactful manner. Physical changes seen through these images include skin lesions, decayed or missing teeth, open sores and premature aging, among other noticeable symptoms. It is important to note that not all of the deterioration and facial change seen within these people is necessarily the cause of drug use, but illicit substances have surely assumed at least some responsibility for the visible toll taken on these 10 individuals. The Rehabs.com webpage aimed to serve as a source of education and inspiration, not only for those who came upon it but also for the addicts featured on the site. Lest anyone feel that the images are being used to shame, embarrass or exploit those in need of help, the website includes a disclaimer that not only invites users to request the removal of their photo, but also offers financial assistance for those seeking treatment. It also acknowledges that the images shown represent only the most extreme cases of drug abuse, but makes sure to mention that those featured in the images likely never anticipated such a slippery slope towards extreme addiction. The statistics on drug abuse are pretty stunning. In 2013, over 24 million people reported that they had taken illicit drugs or abused prescription medication in just the past month alone. One year earlier, more than 1.7 million people had been admitted into treatment programs for substance abuse. While certainly representing a staggering number, that doesn’t address the vast majority of drug users in need of help. And although statistics can be impactful in their own right, the personal cost of drug abuse is probably best represented in the faces of those most affected by it. Different drugs carry their own common side effects. Meth is known to cause facial wasting and open sores, cocaine can be an appetite suppressant and lead to weight loss, ecstasy often causes teeth grinding and even marijuana can age and pale the skin over time with excessive use. But even more than the symptoms of any one drug, the most damaging impact of substance abuse might be the mental side of the addiction, where recreating that high becomes a driving force in the addict’s life and leads to self-neglect.
