As I discuss in this video, Social Security disability administrative law judges will assume you cannot work while you are actively undergoing chemotherapy or radiation treatment and for several months thereafter. However, if you find yourself unable to reliably work due to long term complications from chemotheraphy such as cognitive impairment, poor concentration, memory loss or mood swings, or if your are experiencing physical issues post radiation such as muscle pain, loss of strength or loss of flexibility, those factors are relevant to a disability inquiry. How Can You Prove a Diagnosis of Cancer Qualifies You for Disability Benefits?

Social Security Disability Cancer Claims: The Social Security Administration views Cancer as a long term disability, when it's expected to last 12 months or longer or has been found to be inoperable and terminal. When cancer responds to treatment a patient may be considered able to go back to work within 12 months. The Social Security Listings of Impairments, also referred to as The Blue Book, lists their medical requirements for cancer under listing 13.0. All Cancers are further divided into 27 different sections, each with a specific and technical description of the SSA's threshold of disability for that particular type of cancer. Cancer also results in serious secondary conditions, such as: - Fatigue - Depression Many cancers are listed on the SSA list of Compassionate Allowances conditions. This allowance allows claims to be fast tracked for benefits for claimants whose medical conditions are so sever that it is evident that their illness meets the disability standard. How can Social Security deny claims for Cancer Disability? Although Cancer is recognized as a sever impairment, we've seen many initial claims for cancer benefits denied. If the cancer is discovered at an early stage the SSA may inaccurately decide that treatment will lead to remission, side effects of treatment may not have been considered. Many first claims are incomplete, without sufficient objective evidence for the SSA to justify an award of benefits. A critical part of Cancer disability claims is to show the SSA that you are in fact unable to work at your past job or at any other job according to their vocational guidelines. Don't give up on your claim. For the best chance of winning benefits under the Social Security Disability Program keep appealing and get an experienced attorney on your side. Veterans Disability Cancer Claims: Under the Veterans Disability system the VA decision maker will look to the VA rating schedule to asses the level of your service connected disability. Cancer disability is rated according to the loss of function it has caused and the effect on your ability to work. Veterans may have been exposed to substances such as Agent Orange and Radiation that are known to cause cancer. Many of these Veterans were exposed to these agents several decades ago and are now at an age where cancer may develop. If a Vietnam veteran suffers from a list of impairments the VA will presume that the Cancer disability was caused by exposure to Agent Orange. In addition, Veterans exposed to Radiation from atomic weapons, fall-out and nuclear reactors have presumptive conditions. There are 21 different types of Cancers related to exposure to radiation. Long Term Disability Insurance Cancer Claims: Long Term Disability Insurance is offered by employers as benefits packages to employees or sold by insurance companies to individuals. Although insurance providers say they'll pay Long Term Disability Benefits if you are unable to work, many will deny valid claims, minimize payments, or find ways to delay payments hoping you will give up and abandon your claim. Reasons in support of Long Term Disability Cancers claims include: - Cancer Treatment - Side-Effects from Medication - Invasive Chemotherapy and Radiation treatments All of which can leave the patient seriously fatigued and sick. As well as the effect of their cognitive function such as memory, focus and inability to absorb and analyze information. Insurance Companies will challenge this saying that the patient is exaggerating or not giving their maximum effort. If your insurer has denied your Cancer disability claim don't give up. A court of law may view the insurance companies denial much differently when all of the facts are raised and properly presented. An experienced disability insurance lawyer representing your claim can make a huge difference when fighting against a large insurance company. http://IncredibleRetirement.com 800-393-1017 Recently a client sent us a copy of Suze Orman's Guide to Retirement and asked us for our thoughts. Here's what we told them; While I personally don't care for how Suze delivers her advice or opinions, I do tend to agree with most of what she has to say, which is also very similar to Dave Ramsey and I'm sure many others like them. As I skimmed through the article, 5 thoughts crossed my mind: 1. I don't think our client is Suze's typical audience. I could be wrong, but I think her typical audience are folks who, for the most part, are living paycheck to paycheck with some consumer debt and not a whole lot of savings. 2. The work until you're 70 years old advice is good for her typical audience; but I don't think it applies to the majority of our clients, at least from a financial sense. On the other hand, if you enjoy what you're doing, why stop just because you've arrived at some arbitrary age. 3. Claiming social security at age 70 is in most cases mathematically correct. If you're married it provides the surviving spouse with a potentially bigger social security benefit if they out-live you. But what we usually see is folks starting social security after they retire or when they reach full retirement age. That's because no one knows for sure how long they'll live. Health can change without notice and accidents do happen. 4. We totally agree with being debt-free including the mortgage at or before retirement. Living debt-free just puts less stress on your remaining investments and creates more peace of mind for you. 5. The save less in your retirement account advice might be good for Suze's typical audience, but I don't recommend it for our clients or higher income earners in general. The reason I say this might be good for her typical audience, is that it assumes folks have the self-discipline to use the extra money that they're no longer putting into the retirement plan at work to pay off consumer debt and mortgages. I think most folks, unfortunately, don't have the level of self-discipline necessary to make this happen. The important thing to ask yourself when you come across generic advice, is who is the target audience? And, am I part of that audience? Knowing how generic financial advice applies to your specific situation can move you one step closer to experiencing your version of an incredible retirement, doing what you want, when you want, with the resources you already have.

She's a strong woman but in her life her twin sister has had this also and so she is terrified. Concha has worked most of her life helping others. She is a CNA (Certified Nursing Assistant) that has worked in nursing homes, state run facilities for the mentally handicapped, ALF (Assist living facility) and private homes for the invalid. Now in her late 60's she find herself in the need of help! Her husband in his mid 60's can't find work and care for her needs while going through Chemo and Surgery and recovery times. They both have some money coming in through Social Security but this is not enough to cover her co-pays for treatment and some drugs not covered by social security. Add that to his cost for drugs via the VA which are not covered since he's classified as non-service related of $165 every three months. Genetic Testing Results are Now Acceptable Evidence in Your Social Security Disability Case

Last year SSA published a ruling - SSR-16-4p https://www.ssa.gov/OP_Home/rulings/di/01/SSR2016-04-di-01.html which says that judges may consider genetic test results as evidence in a disability determination. As you may know, scientists have identified a number of diseases that are associated with genetic markers. Some of the better known medical disorders that show a high correlation to specific genetic mutations include breast cancer, ovarian cancer, celiac disease, age related macular degeneration, bi-polar disorder, sickle cell anemia and early onset Alzheimer’s. As I note in this video, simply having a genetic marker for a disease does not necessary mean that you will develop that disease but making genetic testing results available to the judge may help tip the balance in your favor. It’s the kind of diagnosis that can destroy a person. In this case, it also ruined a family. Wiramon Inthaneth lives in Thailand, and at 36 , she thought she had it all. A Loving husband, Happy kid, A decent job. And then…the shoe dropped. Wiramon was diagnosed with terminal breast cancer six months ago. Her situation has become so serious that she has had to move in with her father. The Thai woman's condition means she can no longer work as she is in too much pain and must visit hospital daily to manage her symptoms. But let's remember the Social Security definition of disability is the inability to work because of your condition for at least a 12 month period of time. Modern medicine has been really good and making great strides in treating cancer and many times even though you have cancer you can undergo surgery or chemotherapy or radiation or other kinds of cancer treatment and your cancer can be controlled in less than one year and the symptoms of your treatment do not linger for more than a year. If that's the case then you really don't have a condition that meets the definition of disability for Social Security benefits. On the other hand, there are people whose condition cannot be controlled by treatment or who have severe and lingering side effects from the treatment that are debilitating. if this is the case for you and it looks like you're not going to be able to work for at least one year, then you have a good claim for Social Security Disability benefits.

Disability insurance companies will not dispute a diagnosis of cancer. The problems occur once a person is cured of the cancer, or it has gone into remission, but the person still suffers from symptoms.
